Terms of service
Buy Haggis – Terms and Conditions
Overview
This website is operated by Buy Haggis, part of All Over Foods Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Buy Haggis.
Buy Haggis offers this website, including all information, tools and services available from this site, subject to these terms, conditions, policies and notices. By visiting our site or purchasing something from us, you engage in our service and agree to these Terms and Conditions, including the policies linked below.
Nothing in these terms excludes or limits your statutory consumer rights, our responsibilities for the goods we supply, or any liability that cannot lawfully be excluded or limited. Our shipping policy and returns and refunds policy explain delivery arrangements and remedies in more detail.
1. Contract
All purchases constitute a binding contract between the purchaser and All Over Foods Ltd, trading as Buy Haggis. An order confirmation is not a dispatch notification.
2. Definition
Goods: products sold by All Over Foods Ltd via Buy Haggis. Services: services provided by All Over Foods Ltd related to the sale of goods. Purchaser: the individual or business purchasing goods. Supplier: All Over Foods Ltd.
3. Governing Law
These terms are governed by the laws of Scotland, subject to any mandatory consumer protections that apply. Nothing in this clause removes a consumer's right to bring proceedings in a court available to them under applicable law.
4. Payment Terms
We accept the payment methods displayed at checkout. Payments are processed securely. All applicable charges will be displayed during checkout.
5. Shipping Information
Please provide an accurate delivery address, postcode and contact details. Contact us promptly if you discover an error. We will explain any practical consequences or reasonable additional costs before agreeing a change; your statutory rights remain unaffected.
Delivery services, indicative prices and transit estimates are described in our shipping policy. Estimates run from dispatch. Express is not a blanket next-day guarantee, and Saturday must be selected as a separate service where available.
We aim to meet preferred dates, but earlier or later delivery can occur, especially in December and January. Contact us before ordering for an essential deadline. An advance order may be held for dispatch nearer the requested date.
We remain your point of contact for delivery problems and will investigate with the courier. Dispatch does not remove our responsibilities for the goods or your rights if an order is late, missing, damaged or otherwise does not meet the contract. Delivery and transfer of risk are governed by applicable law and any specific delivery instructions you give; placing an order is not blanket consent to leave it anywhere unattended.
6. International Deliveries and Import Restrictions
Contact us before placing an international order so that the exact product, destination and delivery arrangements can be confirmed. International enquiries are limited to eligible tinned haggis and selected destinations; there is no general worldwide fresh-food service. A shipping quote alone does not establish import eligibility.
Check any applicable recipient-paid customs charges before ordering. We will assist with relevant order information if a customs issue arises. Nothing in this clause transfers our legal responsibilities to the purchaser or removes statutory rights.
7. Customer Complaints
We aim to respond to complaints within five working days. Please contact us promptly, especially about chilled food, using our contact form or info@alloverfoods.com.
8. Quality Assurance and Temperature in Transit
Fresh and chilled food is sent in insulated packaging with gel ice packs. Some products may be dispatched frozen; follow the product information and instructions supplied. Packaging helps protect food but is not a guarantee of safety after any duration of delay.
Unpack promptly and store products according to their labels. If you are concerned about their condition, do not taste or eat them and contact us. We will investigate; using a courier does not remove our legal responsibilities for delivery or product condition.
9. Events Beyond Our Control
Events such as extreme weather, strikes, supply disruption or customs delays can affect fulfilment. We will explain the available options when an order is affected. These events do not automatically remove a customer's rights to cancellation, a refund or another remedy under applicable law.
10. Privacy Statement
Our privacy policy explains how we handle personal information and your data-protection rights.
11. Stock Availability
If we cannot supply a product or its stated weight, we will contact you about an available alternative or a refund. We will not require you to accept a materially different product.
12. Returns and Refunds
Our returns and refunds policy sets out cancellation rights, return arrangements, costs and refund timing. Rapidly perishable goods can be exempt from change-of-mind cancellation, but this does not remove rights over faulty, damaged, incorrect or misdescribed goods. Eligible non-perishable online purchases can have change-of-mind cancellation rights.
Please report problems as soon as you discover them. Photographs are helpful where possible, but there is no blanket 24- or 48-hour reporting deadline that removes statutory rights. Contact us before returning food so we can arrange appropriate handling. Where a return is required for faulty or incorrect goods, we arrange or cover the appropriate return costs.
13. Weather Delays
Adverse weather can extend delivery times. Contact us if your order is affected, particularly where chilled food or an essential delivery deadline is involved. Refunds and other remedies are assessed according to the circumstances and your statutory rights, not excluded automatically because weather was involved.
14. Product Images and Descriptions
Images are illustrative and packaging or presentation may vary. This does not remove the requirement for goods to match their description. Check the exact product's ingredients, weight and dietary information.
15. Haggis Weight and Product Substitution
Where a substitution is proposed, we will explain it and seek agreement before supplying a materially different item. We will not substitute a product with different dietary suitability without your agreement. You do not have to accept a substitute instead of the remedy to which you are entitled.
16. Age Restrictions
Alcohol can only be purchased by customers aged 18 or over. Orders breaching this requirement will be cancelled.
17. Website Liability
We aim to keep website information accurate and will correct errors brought to our attention. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited.
18. Order Cancellations
Orders can be cancelled before dispatch; contact us promptly with your order number. After dispatch, the applicable rights depend on the type of goods and reason for cancellation, as explained in our returns and refunds policy. If we cancel because we cannot supply an order, we will refund payment for goods we cannot supply.
19. Cookies
Our website uses cookies. See our privacy information and available cookie controls for details.
20. Feedback and Reviews
We welcome customer reviews but reserve the right to remove offensive or inappropriate content.
21. Free Delivery
Free delivery applies only where explicitly advertised for an eligible order. The offer's destination restrictions and other conditions apply; check the final charge at checkout.
22. Lost or Stolen Parcels
If tracking says delivered but you cannot locate a parcel, contact us promptly. We will investigate the delivery evidence and any instructions given. A courier's delivered status alone does not automatically remove our responsibilities or your statutory rights. Arrange for someone to receive chilled food or choose any authorised safe place carefully.
23. Gift Messages
We reserve the right to refuse printing offensive or inappropriate gift messages.
24. Right to Refuse Service
We may refuse service or cancel orders where fraudulent activity or abusive behaviour is suspected, subject to applicable law and any refund due.
25. Changes to Terms
We may amend these terms for future orders. Changes do not retrospectively remove rights relating to an existing purchase.
26. Promotional Offers
Offers are subject to their stated terms and availability. Discounts cannot be combined unless stated otherwise.
27. Ingredients and Allergens
Check the exact product's ingredients and allergen information before ordering and read the label when it arrives. Contact us if information is missing, unclear or inconsistent so we can check it with the supplier. Dietary descriptions do not guarantee suitability for every allergy. This guidance does not exclude our responsibilities for accurate food information or product safety.
28. Intellectual Property
Website content owned by All Over Foods Ltd is protected by applicable intellectual-property law. Unauthorised copying or redistribution is prohibited, subject to rights and exceptions provided by law.
29. Bulk or Corporate Orders
Special terms may apply to business orders where agreed in advance. Contact us for details. Consumer rights are not removed merely because an order contains several items.
30. Failed Deliveries
If delivery cannot be completed, contact us promptly so we can help. Recipient unavailability, incorrect instructions or refusal may affect the practical options, especially for chilled food. Any further delivery arrangements, reasonable costs and refund entitlement will be considered in the circumstances and in line with applicable law, rather than a blanket refusal of all refunds.
